The North Carolina Supreme Court has decided it will rule on a case involving the future of the Winston-Salem Northern Beltway. The justices say they will review a lower-court ruling that said the state must pay landowners for essentially taking their property without compensation.
The case hinges on whether the state Department of Transportation had the right to place hundreds of Forsyth County properties in a protected corridor along the proposed Beltway. Under the Map Act, the NCDOT can enforce a ban on applying for building permits and places restrictions on development.
The Winston-Salem Journal reports the ruling affects roughly 170 property owners in the path of the future freeway.
The landowners claim that in addition to not being compensated, the designation has depressed their property values and limited the use of their land.
The state is acting on an NCDOT petition to review the lower court's decision.
