The State Board of Education has sued a North Carolina government panel over whether the board must get the panel's approval on how it carries out public school policies. Some lawmakers believe the education board must give up some money so the rules panel can better defend itself in court.
The Senate Appropriations Committee recommended a measure Tuesday that transfers $100,000 from the school board to the Rules Review Commission for legal expenses. It's an unusual demand, but Sen. Harry Brown of Jacksonville says the legislature sides with the rules commission. Another senator suggested the lawsuit was frivolous.
The measure will be on the Senate floor Wednesday. The provision also locates current-year state education funds to operate an academic standards panel recommending changes to Common Core.
