The family of a student killed in an alleged hazing incident at High Point University is appealing a superior court judge's decision to dismiss parts of the case. The case against two of the four defendants was dismissed in June. The case against the fraternity and Michael Quebain was continued.

 

 The family of Robert Tipton Jr. filed an appeal Monday to the upper level court's decision to dismiss the wrongful death case against the university and its director of security. According to the Greensboro News and Record, to appeal that partial dismissal, the family had to ask the court to dismiss the entire case.

The university disputes the basis for this appeal. Yesterday, the university strongly rejected the allegations in the original wrongful death lawsuit.

Defendant Michael Qubein is the son of High Point University President Nido Qubein.

Tipton died March 2012. The state medical examiner listed Tipton's cause of death as oxymorphone poisoning. But the family sued, saying Tipton died because of hazing.
