A Delaware judge is mulling Duke Energy's request for a six-month halt to a shareholder lawsuit. These legal proceedings come as the company tries to finalize a $102 million settlement of a federal criminal investigation.

After hearing arguments Tuesday, the judge declined to rule immediately but said he would wait to see the outcome of a hearing in the criminal case next week in North Carolina. He also wants to see the results of a status hearing next week regarding several enforcement actions brought by North Carolina environmental regulators.

The plaintiffs, who oppose the delay, accuse Duke Energy officers and directors of knowingly allowing the company to repeatedly violate state and federal environmental laws in its storage of coal ash.
