Despite a statutory rape conviction, Polanski has been nominated for three Academy Awards. He won the best director award in 2003 for his film The Pianist.
A Polish court last year denied a U.S. request to extradite Polanski, who pleaded guilty in 1977 to statutory rape but fled. Now Poland's justice minister says he'll appeal to the Supreme Court.
The judge in the case, Dariusz Mazur, said the U.S. request wasn't admissible under Polish law. Roman Polanski, 82, has both French and Polish citizenship.
