A 1979 state supreme court ruling said it's not rape if a person changes their mind during sex and their partner doesn't stop. A North Carolina lawmaker wants to make it a crime.

A three-judge panel from the 7th U.S. Circuit Court of Appeals ruled Dassey should be released unless the state of Wisconsin decides to retry him within 90 days or appeals to the U.S. Supreme Court.

"We have never read a statute to strip citizenship from someone who met the legal criteria for acquiring it," Justice Elena Kagan wrote. "We will not start now."

The six men, all of Arab or South Asian descent, were in the U.S. illegally when they were detained. They say they were held under harsh conditions after the September 11 attacks.

It offers the court a chance to formally determine a metric on what constitutes unlawful gerrymandering, which could have major implications for the way voting districts are drawn in other states.

North Carolina Republican legislative leaders refused Thursday to hold a special redistricting session demanded by Democratic Gov. Roy Cooper, calling his decree faulty and unconstitutional.

For the second time in two years, the U.S. Supreme Court has told North Carolina's highest court to review the state's political maps.

"A State may not use race as the predominant factor in drawing district lines unless it has a compelling reason," Justice Elena Kagan said in the court's opinion upholding a lower court ruling.
